The National Bureau of Vigilance Against Antisemitism supports the protests of Mr Joel Rubenfiel, President of the Belgian League Against Antisemitism who deplores and accuses Belgian justice of having exonerated a European civil servant of proven and flagrant violent anti-Semitism.

The facts date back to July 2015, shortly before midnight, on the terrace of a café in the European district. The victim, a European civil servant, calls out to a man brandishing a metal plate bearing the words " Mussolini ". She tells him that Mussolini was a dictator. A discussion ensued and the man, also a European civil servant, called his interlocutor " dirty jewish and makes threats like " you all should have been killed ».

With his plate, he hits the victim on the head, and tries to strangle him. The next day, the victim files a complaint. She also presents a medical certificate attesting to head trauma, concussion and pain on the right side of the head. She will be prescribed analgesics, psychological and neurological monitoring. Mals the Belgian Justice acquits the violent anti-Semite.

Mr Joël Rubinfeld writes in particular  According to this decision, the law allows these statements to be made publicly because they, even made in public, do not incite hatred. I know, it sounds amazing. But it's true The Court of Appeal had to judge an attack against a lady committed on July 16, 2015 by a certain SG, a senior European official. SG, drunk at a party in a bar, violently hit the victim and tried to grab her by the neck, while calling her a "dirty Jew" and telling her "you (Jews) should have all be killed”.The Court of Appeal recognizes that the aggression took place, and condemns SG for having committed it. It also acknowledges that these remarks were made and therefore decides that one of the motives for the attack is the "alleged religious conviction of the victim", namely, his supposed membership of the Jewish community.On the other hand, according to the court, the remarks made by SG “do not constitute an encouragement, an exhortation or an instigation of anyone and therefore do not constitute an incitement” to hatred or violence. He is therefore acquitted of this fact..

In his open letter Mr Rubenfeld lists the anti-Jewish attacks that have had no criminal consequences 

The BNVCA has decided to contact the Belgian ambassador in France to express our support for the protests of the President of the LBCA, as well as for the Jewish community in Belgium, victim of numerous anti-Semitic acts and attacks, and to ask him to intervene with of his government to ensure that anti-Jewish perpetrators are tried and sentenced.
